Terms & Conditions

These Affiliate Program Terms & Conditions (“Affiliate Terms”) govern participation in the OMC Studio Affiliate Program (“Program”).
By registering for or participating in the Program, you (“Affiliate”) agree to these Affiliate Terms. If you do not agree to these terms, you should not participate in the Program.
1. The Affiliate Program
The Program allows affiliates to promote eligible OMC Studio products and services using referral links provided through their affiliate account.
When an eligible customer makes a qualifying purchase through a valid referral, the Affiliate may earn a commission in accordance with these Affiliate Terms.
Participation in the Program does not create an employment, agency, partnership, joint venture, franchise, or similar relationship between OMC Studio and the Affiliate.
2. Affiliate Eligibility
You must provide accurate and complete information when creating and maintaining your affiliate account.
OMC Studio reserves the right to review, reject, suspend, or terminate an affiliate account where we reasonably determine that the account, promotional methods, referrals, or other activity violates these Affiliate Terms or threatens the integrity of the Program.
3. Affiliate Commission
Unless otherwise stated for a specific promotion, eligible affiliates earn 50% of the customer’s initial subscription payment for qualifying subscription purchases attributed to their affiliate account.
Subscription renewals are not commissionable.
Based on current Bulk Trademark Monitor pricing, examples include:
- Starter — $7.95 initial payment → approximately $3.98 commission
- Growth — $14.95 initial payment → approximately $7.48 commission
- Scale — $34.95 initial payment → approximately $17.48 commission
Commission amounts may be rounded to the nearest cent.
4. Referral Tracking
The standard referral tracking window is 30 days.
A referral must be properly recorded by OMC Studio’s affiliate tracking system to qualify for commission. Clicking or sharing an affiliate link does not by itself guarantee attribution.
Tracking may be affected by browser settings, deleted or blocked cookies, privacy technologies, device changes, or other technical conditions outside OMC Studio’s reasonable control.
OMC Studio’s affiliate records will be used to determine referral attribution and commission eligibility, subject to correction of clear technical or administrative errors.
5. Commission Validation
Referral commissions are subject to a standard 30-day validation period before becoming eligible for payout.
This period allows OMC Studio to account for refunds, cancellations, chargebacks, payment disputes, fraudulent transactions, duplicate transactions, and other circumstances that may make a referral ineligible.
A commission appearing in the Affiliate Portal should not be considered finally payable until it has completed the applicable validation requirements.
6. Payouts
The standard minimum affiliate payout threshold is $25 USD.
Affiliate payouts are currently made through PayPal. Affiliates are responsible for providing and maintaining accurate payout information and a PayPal account capable of receiving payment.
Eligible commissions below the minimum payout threshold will remain in the affiliate account until the threshold is reached, subject to these Affiliate Terms.
Affiliates are responsible for taxes, reporting requirements, PayPal requirements, and other obligations that may apply to their affiliate earnings.
7. Refunds, Chargebacks & Reversed Transactions
Commission is not payable on transactions that are refunded, reversed, charged back, fraudulent, canceled, duplicated, or otherwise determined to be ineligible.
If commission has already been credited for a transaction that later becomes ineligible, OMC Studio may reverse or deduct the corresponding commission from the Affiliate’s unpaid or future commission balance where appropriate.
8. Self-Referrals
The Affiliate Program is intended for referring new customers to OMC Studio.
Self-referrals are not eligible for commission.
Affiliates may not use their own affiliate link, directly or indirectly, to earn commission on their own purchases.
Attempts to circumvent this restriction through another account, identity, email address, payment method, or similar arrangement may result in the commission being rejected and the affiliate account being suspended or terminated.
9. Acceptable Promotion
Affiliates may promote OMC Studio through legitimate channels such as websites, blogs, newsletters, social media, videos, educational content, communities, and direct recommendations where appropriate.
Affiliates must represent OMC Studio and its products accurately and must not make false, deceptive, misleading, or unsupported claims.
Affiliates may not claim or imply that they are OMC Studio, an employee of OMC Studio, or an official representative of OMC Studio.
Affiliates are responsible for clearly disclosing their affiliate relationship where required by applicable advertising, endorsement, consumer-protection, or similar laws and regulations.
10. Prohibited Promotional Methods
Affiliates may not:
- Use spam or unsolicited bulk messaging to promote OMC Studio;
- Make false, misleading, deceptive, or unsupported claims;
- Misrepresent OMC Studio pricing, features, capabilities, results, or guarantees;
- Use fraudulent, artificial, incentivized, or manipulated transactions;
- Mislead users into clicking an affiliate link;
- Use cookie stuffing, forced clicks, hidden redirects, or similar tracking manipulation;
- Impersonate OMC Studio;
- Create a website, account, advertisement, or other property likely to be confused with an official OMC Studio property;
- Use OMC Studio branding in a misleading or deceptive manner;
- Engage in unlawful promotional activity.
11. Trademark Monitoring Claims
When promoting Bulk Trademark Monitor or another trademark-related OMC Studio service, Affiliates must not describe the service as legal advice or claim that it guarantees that a phrase, design, listing, product, or other material is legally safe to use.
Affiliates must not promise that use of the service will prevent trademark claims, marketplace takedowns, account suspensions, legal disputes, or other legal or commercial consequences.
Bulk Trademark Monitor is a monitoring and informational service and is not a substitute for advice from a qualified legal professional.
12. OMC Studio Brand & Promotional Materials
OMC Studio may provide affiliates with logos, graphics, copy, links, screenshots, or other promotional materials.
These materials may be used solely for legitimate promotion of OMC Studio under the Program and may not be used in a deceptive, defamatory, unlawful, or misleading manner.
OMC Studio names, branding, content, software, graphics, and other intellectual property remain the property of their respective owners.
13. Affiliate Account & Referral Review
OMC Studio may review affiliate accounts, referrals, traffic sources, promotional methods, and related activity for fraud prevention, compliance, commission validation, and administration of the Program.
We may request reasonable information relating to a referral or promotional method where necessary to determine commission eligibility.
Commissions generated through activity that violates these Affiliate Terms may be rejected or reversed.
14. Program Changes
OMC Studio may modify the Affiliate Program, including commission rates, eligible products, tracking periods, payout thresholds, payout methods, promotional rules, or these Affiliate Terms.
Material changes will apply prospectively as appropriate. Continued participation in the Program after updated terms become effective constitutes acceptance of the updated Affiliate Terms.
15. Suspension & Termination
Either party may end the affiliate relationship at any time.
OMC Studio may suspend or terminate an affiliate account for violation of these Affiliate Terms, suspected fraud, abusive activity, misleading promotion, manipulation of referral tracking, or other conduct that reasonably threatens OMC Studio, its customers, or the integrity of the Program.
Valid commissions earned before termination may remain payable subject to normal validation and payout requirements. Commissions associated with prohibited, fraudulent, or otherwise ineligible activity may be rejected.
16. No Guarantee of Earnings
Participation in the Program does not guarantee any particular level of traffic, referrals, conversions, commissions, or earnings.
Affiliate results may vary depending on audience, promotional activities, market conditions, and other factors.
17. Limitation of Liability
To the maximum extent permitted by applicable law, OMC Studio will not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in the Affiliate Program, including loss of anticipated commissions, revenue, profits, data, or business opportunities.
Nothing in these Affiliate Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
